NEONIKA – WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND MEDIA CONSENT AGREEMENT

By purchasing a ticket and entering NEONIKA, you voluntarily agree to the following terms:

Assumption of risk
Participation in NEONIKA’s immersive experiences involves inherent risks, including but not limited to: slips, trips, and falls; uneven or dark surfaces; collisions with exhibits, props, walls, installations, staff, or other guests; sensory effects including flashing lights, strobe lights, projections, lasers, fog, mirrors, reflective surfaces, loud music, sound effects, confined spaces, moving imagery, and immersive environments; interactive or physical installations; crowd movement; equipment malfunction; actions of other participants; and unforeseen accidents that may result in bodily injury, illness, emotional distress, property damage, permanent disability, or death. Sensory effects may trigger seizures, dizziness, disorientation, anxiety, claustrophobia, or other physical or psychological reactions. By completing this purchase, you voluntarily assume all known and unknown risks associated with participation.

Release of liability
To the fullest extent permitted by California law, you release and discharge NEONIKA and its owners, affiliates, landlords, property owners, employees, contractors, artists, vendors, insurers, staff, agents, representatives, successors, and assigns (“Released Parties”) from any claims, liabilities, damages, losses, or causes of action arising from participation, including claims arising from ordinary negligence. This release does not apply to gross negligence, willful misconduct, or liabilities that cannot legally be waived under California law.

Participant responsibilities
You agree to: follow all posted rules and staff instructions; behave safely and respectfully; avoid reckless or dangerous conduct; immediately report unsafe conditions to staff; and leave any area if instructed by NEONIKA personnel. You agree not to participate while intoxicated or under the influence of alcohol, drugs, or any substance that may impair judgment, coordination, awareness, or safe participation. NEONIKA reserves the right to deny entry or remove any participant without refund for unsafe, disruptive, unlawful, intoxicated, or inappropriate behavior.

Medical acknowledgment
You certify that you are physically and mentally capable of participating. Certain installations may not be suitable for individuals with epilepsy, seizure disorders, heart conditions, claustrophobia, sensory sensitivities, balance disorders, pregnancy, or other medical conditions affected by lights, sound, motion, or physical activity. In the event of an emergency, you authorize NEONIKA to obtain medical care on your behalf and accept full financial responsibility for any resulting treatment or transportation.

Personal Property
NEONIKA is not responsible for lost, stolen, or damaged personal property. You agree to exercise reasonable care while interacting with installations and exhibits, and accept financial responsibility for damage caused by reckless, intentional, or negligent conduct.

Photo, Video, and Media Release
Photography, video recording, livestreaming, and surveillance may occur within NEONIKA. You grant NEONIKA the irrevocable right to photograph, film, record, and use your image, likeness, appearance, and voice for promotional, advertising, editorial, archival, social media, and commercial purposes worldwide, in perpetuity, without compensation or approval rights.

Ticket and Refund Policy
Tickets that have been scanned or used for entry are non-refundable. For unused tickets, refund requests must be submitted at least 24 hours prior to the scheduled date and time slot. No refunds will be issued for requests made less than 24 hours before the event, or in cases of no-show, late arrival, early departure, or scheduling conflicts.
Tickets are valid only for the date and time slot selected at the time of purchase and may not be transferred or resold without prior written authorization from NEONIKA.
NEONIKA reserves the right to cancel, modify, or reschedule events due to unforeseen circumstances. In such cases, ticket holders may be offered a replacement date or store credit.

Minors
If you are purchasing tickets for participants under 18, you represent that you are their parent or legal guardian and agree to these terms on their behalf.

Governing Law
This agreement is governed by the laws of the State of California. Any disputes shall be resolved exclusively in Los Angeles County, California.
